MailCan wants everyone to use emails politely and responsibly.

What Is Spam?

Spam is sending emails to people who didn’t ask for them. Read the “What Does Obtaining Consent Mean?” section below for more.

Get Permission Before Sending Emails:

The person said it’s okay to email them, like signing up on your website.

Keep Proof of Permission:

Save records showing that people agreed to get your emails.

Always Include an Unsubscribe Option:

Every email must have a clear way for people to stop getting emails from you. If someone unsubscribes, remove them from your list within 10 business days.

Be Honest and Legal:

Your emails should be truthful and follow all laws. Don’t send emails to children under 13 years old.

Don’t Buy, Share, or Sell Email Lists:

Keep your email lists to yourself. Don’t give or sell them to others.

Handle Complaints Nicely:

If someone has a problem with your emails, be ready to fix it quickly.

What Does “Obtaining Consent” Mean?

Obtaining consent means you have clear permission from someone to send them emails. This means the person has agreed to receive messages from you before you start emailing them.

✅ Acceptable Examples:

  1. Signing Up on Your Website:
    • Example: Jane visits your website and fills out a form to receive your monthly newsletter.
  2. Making a Purchase:
    • Example: Tom buys a product from your online store and checks a box saying he wants updates about new products.
  3. Entering a Contest:
    • Example: Maria enters a contest you host and agrees to receive emails about the results and future contests.
  4. Opt-In Checkbox (Not Pre-Checked):
    • Example: When creating an account, Ben sees an empty checkbox that says “Yes, I want to receive emails” and he chooses to check it.

🚫 Forbidden Examples:

  1. Buying Email Lists:
    • Example: You purchase a list of emails from another company and start sending them your newsletters without their permission.
  2. Emailing Without Interaction:
    • Example: You find email addresses online and send them promotions even though they’ve never heard of you.
  3. Pre-Checked Boxes:
    • Example: On your sign-up form, the box that says “Send me emails” is already checked, and the person might not notice it.
  4. Ignoring Unsubscribe Requests:
    • Example: Sarah unsubscribes from your emails, but you keep sending them to her anyway.
  5. Assuming Consent from a Friend:
    • Example: You ask your customers to provide their friends’ email addresses and start emailing those friends without their permission.

Always ask people if it’s okay to email them, and make sure they agree before you do. If you send emails without their permission, it’s considered spam, which is not allowed and can lead to trouble.

In Canada, under the Canada Anti-Spam Legislation (CASL), sending spam or emails without proper consent can result in severe penalties—up to $1 million for individuals and up to $10 million for businesses per violation. Ensure you have proper consent before sending emails to avoid these fines.

What Happens If You Break the Rules?
